The following terms and conditions apply to purchase of rootstocks from Old Tower Farm. ( Herein “Seller”)
Seller exclusive warranty: Seller’s product is warranted to be true to name, graded for quality, carefully stored to maintain their high quality and properly packed to reach the purchaser in the best possible condition. The plant materials have been inspected and are visibly free from plant disease. Seller cannot assure detection of plant disease, viruses or defects not visible with the naked eye.
What is not covered by the warranty: Because growth of nursery stock is determined to a large extent by the care it receives from the planter and grower due to conditions beyond the seller’s control, including but not limited to soil, weather, purchaser’s negligence and improper use of chemicals or fertilizers, the seller cannot and does not warranty or guarantee growth.
All nursery stock is offered for sale subject to crop yield. The seller reserves the right to prorate or cancel any order because of strike, fire, frost, flood, drought, disease, or other circumstances beyond the seller’s control.
Receiving and handling: Nursery stock is perishable. All shipments should be immediately and carefully inspected on arrival, and then placed on proper storage. They must be kept from drying out or freezing, and must not be stored in same room as produce (fruits and vegetables).
Claims: The seller guarantees your rootstocks will be in good condition when we ship it to you. Please inspect your order upon arrival and summit any product related claims in writing, to the seller, within 2 days of receipt of order. Warranty doesn’t apply to plant material damaged or injured during shipment. Warranty does not apply to plant material that has been stored, planted, or otherwise treated by the buyer.
Shipping: All nursery stock is shipped at buyers risk and expense F.O.B. Keremeos BC. Packaging materials will be charged at cost. Unless given specific instructions, shipping will be by best available method.
Payment Deposit and cancellation: Buyer must pay 20% deposit within 15 days of order.
Failure to cancel an order by February 15th, will result in forfeiture of the deposit by the seller. Buyer must pay the balance of the full payment prior to shipping
